Delaram Ali Sentenced to Prison; Stay on Implementaion of Sentence Issued by Head of Tehran District Court

Change for Equality: The Sixth Branch of the Tehran Appeals Court issued a ruling in the case of Delaram Ali on the 15th of November 2008, finding her guilty of the lesser charge of disrupting public order from among the three charges initially brought against her and in turn sentencing her to four months mandatory prison sentence and ten lashings which can be eliminated with the payment of a monetary fine. Following the issuance of this ruling, Delaram Ali objected once again to the ruling and an order for the stay of implementation pending further judicial review has been ordered from the Head of the Tehran District Court.

Delaram Ali was arrested during the June 12th, 2006 protest in Haft-e Tir Square and spent a week in prison. Upon release she was charged with actions against national security through the participation in an illegal protest; spreading of propaganda against the state; and disruption of public order. In her original trial Delaram was found guilty of on all the charges against her and sentenced to 2 years and ten months prison term and 10 lashings, which was reduced to 2 years and 6 months in a ruling issued by the appeals court. The appeals court acquitted her on the charge of disrupting public order, but found guilty on the two other charges. Following a letter of protest to the head of the Judiciary, a stay on the implementation of this sentence was issued pending a judicial review. This latest sentence is the result of the judicial review.

Delaram Ali has once again objected to this sentence, citing the fact that the judicial review ruled on a charge on which she was formerly acquitted. In response to this objection, the Head of the Tehran District Court has issued a stay on implementation of this latest sentence pending yet another judicial review.
